The cancellation, return, and refund policy (“policy”), together with the Terms and Conditions set out in Pankhkh’s policies and processes for (a) accepting cancellation, (b) accepting returns , or (c) processing refund which applies to products sold by us.

  1. Applicability Of Policy
    1. By using Bravado and/or initiating a request for the purchase of products on the website, you agree to be bound by the terms contained in this policy without modification. If you do not agree to the terms contained in this policy, you are advised not to transact on Bravado. Please note that we may from time to time change the terms of the policy that govern your terms of cancellation, return or refund of an order for products bought on Bravado. Every time you wish to use Bravado, please check the policy to ensure you understand the terms and conditions that apply at that time.
  2. Terms Of Cancellation
    1. You can cancel the order prior to the dispatch of product by Pankhkh. However, once the products have been dispatched, and you want to cancel the order, you may reach out to customer support and request for order cancellation. We would try to avoid making an attempt for delivery. However, in case the courier still attempts the delivery, you may reject to accept the delivery of the shipment. Refund for prepaid orders will be processed in the original mode of payment upon receipt of the items in our warehouse.
    2. The user can raise a request for cancellation for one or all products, except where the products purchased are part of a (i) package of other products, or (ii) if the products are a part of a promotional package ((i) and (ii) collectively referred to as a (“combo pack”). If you raise a request for cancellation, the combo pack will stand cancelled as a whole.
    3. The request for cancellation of the order can be made by cancelling the order from the ‘Orders’ section by using the order tracking number, or by calling our customer care number, or any other method, as may be intimated by Pankhkh to you from time to time.
    4. On the receipt of an order cancellation request, your order shall be cancelled with immediate effect, and the refund process will be initiated within two (2) business days of confirmation of cancellation.
  3. Terms of Return and Refund
      1. You may initiate the return of products within 15 (fifteen) days of receipt of the order. We would accept the request for the return of such a product subject to the terms of this policy.
      2. If you initiate a return of one or more products in a combo pack then we will initiate return of the combo pack as a whole and not individual products in the combo pack, subject to the terms of this policy. Therefore, if you intend to return one or more products in a combo pack, then you are required strictly not to open or use any other product(s) in the relevant combo pack. We reserve the right, at our sole discretion, to reject return request of a combo pack if the products in the combo pack have been opened/used by you.
      3. You agree that Pankhkh will not process return requests for the following reasons:
        1. Product is damaged due to misuse/overuse;
        2. Product is received in physically damaged condition
        3. Product is used or altered by the user;
        4. Returned without original packaging including, price tags, labels, original packing, freebies and other accessories, or if original packaging is damaged;
        5. Serial Number and/ or the bar code is tampered by the user;
        6. Product is defective and not covered under Seller/Manufacturer’s warranty;
        7. Request is initiated beyond 15 days of order delivery;
        8. Product ordered was customized on demand.
      4. Please note for certain marketing campaigns or mega sale periods, special return/ refund rules may apply. Information regarding this is visible on the promotion banner.
      5. All our packages come with tamper-proof packaging. Please ensure that you do not accept packages where the seal is tampered. Acceptance of a tampered or damaged package will automatically disqualify you from any return claims for physically damaged/defective products, an incorrect product, or missing accessories.
      6. Please be informed that for products, for which you had opted for ‘Cash on Delivery’ as a payment mode, you will receive refunds in your bank account. You will be requested to share your bank details by filling out the pop-up form that appears on the website/app while raising the return request for us to process the refund. Please note that we do not make any cash refunds.
      7. Please be informed that when you opt to cancel or return the products, upon our verification of the products and the documents relating thereto, the refund amount for such products which are eligible for return as per the terms of this policy. We will initiate the refund within a period of two to four (2 to 4) business days from the date we receive the products at our warehouse and verify the defect or the non-compliance in the products. Your refund will be processed only when the conditions as may be stipulated by Pankhkh are fulfilled. The refund amount will be credited to the original payment mode opted for by you. You acknowledge that after initiation of the refund, it may take additional time for your refund to reflect in your account which is subject to your financial institution or payment solution provider’s terms and conditions.
      8. Please be informed that for products, for which you had opted for ‘Cash on Delivery’, as a payment option, you will receive refunds in your bank account (as per the bank account details provided by you to us) within two to four (2 to 4) business days from the day returned product received by us and return is approved by us after verification of the returned product. It may take an additional 2-3 business days for the amount to reflect in your account depending upon the banks and the financial institution. We do not make any cash refunds.
      9. The amount claimed as the refund will be refunded to you within 15(fifteen) working days depending upon the mode of payment chosen by you. Sometimes banks or financial intermediaries take a longer time to process the refund request. However, if the refund does not happen by the date advised, you may contact us and we would be happy to help.

  5. Product availability
    We list availability information for the products on the product display page. Beyond what we say on that product display page or otherwise on Bravado, we cannot be more specific about availability. Please note that dispatch estimates are not indicative in nature and we do not guarantee the dispatch times. As we process your order, you will be informed by e-mail and/or SMS if any products you ordered turn out to be unavailable or out of stock.
  6. Product pricing
    1. All prices are listed in Indian Rupees. Price, as displayed, is inclusive of all applicable taxes.
    2. Products in your shopping cart of Bravado will reflect the most recent price as displayed on the product’s information webpage on the website. Please note that this price may differ from the price shown for the product when you first placed it in your shopping cart. Placing a product in your shopping cart does not reserve the price shown at that time. It is also possible that a product’s price may decrease between the time you place it in your shopping cart and the time you place the order.
  7. Licenses
    You acknowledge that there may be licenses/permissions required under the applicable laws to use, purchase or otherwise possess certain product(s). You will be solely responsible for obtaining such licenses/permissions and complying with the terms of such licenses/permissions.
  8. Taxes
    You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes.
  9. Limitation of liability
    In no event, our aggregate liability, if any, that is proven and ordered by a court of competent jurisdiction pursuant to a claim by you or person acting on your behalf, shall extend beyond the refund of money charged from you for purchases made pursuant to an order under which such liability has arisen and been established. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when a contract for the sale of product by us to you was formed.

Miscellaneous

  1. Access outside the republic of India
    Pankhkh makes no representation that the content on Bravado is appropriate to be used or accessed outside the Republic of India. Any users who use or access Bravado from outside the Republic of India, do so at their own risk and are responsible for compliance with the laws of such jurisdiction. These Terms do not constitute, nor may these Terms be used for or in connection with any promotional activities or solicitation by anyone in any jurisdiction in which such promotional activities or solicitation are not Authorised or to any person to whom it is unlawful to promote or solicit.
  2. Term and termination
    1. These Terms shall be effective from the date of their publication on Bravado.
    2. Pankhkh reserves the right to terminate the Services in the event of breach of any terms contained in these Terms and Conditions, misrepresentation of information, any unlawful activity by you or if Pankhkh is unable to verify or authenticate any information submitted by you.
    3. You may terminate these Terms at any time, provided that you discontinue any further use of Bravado. However, any such termination shall not cancel your obligation to pay for a product purchased on Bravado, or any other obligation which has accrued, or is unfulfilled and relates to the period, prior to termination.
  3. Force majeure
    Pankhkh will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond Pankhkh’s reasonable control.
  4. Waiver
    No provision in these Terms will be deemed waived and no breach excused, unless such waiver or consent is in writing and signed by Pankhkh. Any consent by Pankhkh to, or waiver of your breach, whether expressed or implied, will not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
  5. Severability
    If any provision of these Terms is held by a court of competent jurisdiction to be unenforceable under applicable law, then such provision will be excluded from these Terms and the remainder of these Terms will be interpreted as if such provision were so excluded and will be enforceable in accordance with its terms; provided however that, in such event, these Terms will be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction.
  6. Governing law and dispute resolution
    These Terms, all transactions consummated between Pankhkh and you, and the relationship between Pankhkh and you is governed by the laws of India, without reference to any conflict of laws principles and with an exclusive jurisdiction to the courts of Mumbai.
  7. Amendment
    1. These Terms and Conditions supersede all previous oral and written terms and conditions (if any) communicated to you by Pankhkh, for the use of Bravado, and the rights and liabilities with respect to any services to be provided by Pankhkh shall be limited to the scope of these Terms
    2. These Terms are subject to amendments and modifications and may be updated from time to time, without any advance notice. You are requested to regularly review the Terms and Conditions as available on the website. Your relationship with Bravado will be governed by the most current version of these Terms, as published on Bravado.
  8. Third party terms and conditions
    In addition to these Terms, you will also ensure that you are in compliance with the terms and conditions of the third parties, such as bank offers terms and conditions, brand promotional offers, whose links, if any, are contained/embedded in the services. You agree that Pankhkh will not be liable for any transaction between your and any such third parties.
